How to Get a Rental Property in Melbourne: What Agents Can and Cannot Ask

Renting in Melbourne: Victoria's prescribed Form 3A has 12 items and an agent can ask for a maximum of four documents

Joaquin Trapero, with two decades of expertise in the removal industry, is the owner of North Removals, bringing unparalleled knowledge and proficiency to every relocation.

Since 31 March 2026 there is one rental application form in Victoria, and an agent cannot ask you for anything that is not on it.

Most of the advice still ranking for this search was written before that. Some of it tells you to offer above the advertised rent, which the law here does not allow.

We are removalists Melbourne renters call the week their application is approved, so this covers what the form actually asks, what you can decline, and what happens between approval and keys. For the moving number, see what a Melbourne move costs.

Quick answer

Victoria has a prescribed rental application form, Form 3A, in force since 31 March 2026. Part A has 12 numbered items. An agent may request a maximum of 2 financial documents and 2 identity documents, your current or most recent address plus 1 previous, and 2 referees, and for occupants only a total number.

Asking for anything not on the form is an offence carrying 60 penalty units for a person and 300 for a company. The rule binds the agent, not you, so you can still volunteer extra material if you want to.

Legal position verified 14 October 2026 against the Residential Tenancies Regulations 2021 (Vic) and Consumer Affairs Victoria. Market figures are point in time and move quickly.

Victorian law says renter, rental provider and rental agreement. Older guides still say tenant, landlord and lease.

The prescribed rental application form, and what changed

Regulation 14A of the Residential Tenancies Regulations 2021 states it plainly: the regulation “has effect on and after 31 March 2026”. From that date, Form 3A is the application form for a private rental in Victoria.

The rule about extra questions works in an unusual way. Regulation 15(2) prescribes as prohibited “any information other than the information set out in Form 3A in Schedule 1”.

So it is not a list of banned questions. It is the reverse: everything is off limits unless the form asks for it.

Offence What it covers Penalty units
Section 30ACUsing an application form that is not the prescribed form60 person, 300 company
Section 30C(1)Requesting an applicant to disclose prescribed information60 person, 300 company

Residential Tenancies Act 1997 (Vic) ss 30AC and 30C, with Form 3A prescribed by S.R. No. 123/2025. The dollar value of a penalty unit is set each year, so check the current rate if it matters to you.

One carve out matters. These rules do not apply where the rental provider is Homes Victoria or a registered housing agency, or where the application is for an affordable or specialised housing program.

If you are applying through one of those, being asked for more is not a breach. Our guide to bond loans in Victoria covers the assistance side, and we move renters into new places across the whole of Victoria.

What an agent can ask for on a Victorian rental application

Part A of Form 3A has 12 numbered items. Eleven collect information, and item 12 is your signature.

Several of them carry hard caps printed on the form itself, and those caps are the part almost nobody knows about.

What the form asks for The limit on the face of the form
Financial documents (item 6)Maximum 2, from 3 permitted types
Identity documents (item 7)Maximum 2, from a closed list of 12
Rental history (item 8)Current or most recent, plus 1 previous property
References (item 9)2 referees
Occupants (item 3)A total number only, not names or ages
Bank statement, where you supply oneWithout transaction details

Residential rental application (Form 3A), Schedule 1 to the Residential Tenancies Regulations 2021 (Vic), effective 31 March 2026. Item 6 reads: “A rental provider or their agent may request no more than two documents from the following list.”

The bank statement line is worth reading twice. The form specifies a statement without transaction details, so a request for a statement showing your daily spending is a request for something the form does not permit.

Part B of the form, addressed to the agent rather than to you, says it in one sentence: applicants must not be asked to provide information that is not on the application form.

How much you need to earn depends where you are looking, and the spread across Melbourne is wide. Our page on the Melbourne rental market covers it, and the cost of living in Melbourne puts the rent next to everything else.

What you do not have to provide

This is the part no page currently answers, and it is the question renters actually have: what happens if I say no.

Because the rule is residual, anything absent from the 12 items cannot lawfully be requested. Here are the ones that come up most.

Commonly asked for Why it is not on the form
PetsForm 3A has no pet question. Pets are handled after a rental agreement is offered
Names and ages of your childrenItem 3 asks for a total number of occupants and nothing more
Bond history or past bond claimsNot among the 12 items
Whether you have been to VCAT or in a disputeNot among the 12 items
A bank statement showing daily transactionsItem 6 specifies a statement without transaction details
Your car, or how many vehicles you haveNot among the 12 items
Anything touching a protected attributeProtected under the Equal Opportunity Act 2010 (Vic) s 6

Worked examples of information absent from Form 3A, not a closed list. The rule is that anything not on the form cannot be requested.

Now the qualification that matters, because getting it wrong would leave you worse off. The prohibition binds the agent, not you. Section 30C stops them requesting, it does not stop you volunteering.

If a cover letter or a rental ledger would help your case, you are free to include it. Plenty of successful applicants do, and nothing in the reform changed that.

If you are asked for something off the form, the practical move is to answer the items you are comfortable with and say you would rather stick to the form for the rest. Consumer Affairs Victoria is the place to raise it afterwards.

None of this changes the part that costs money. If you are leaving a place you are still tied to, our guide to breaking a lease in Victoria sets out where you stand, and notice to vacate in Victoria covers the timing.

Rental bidding, and rent in advance

Several pages ranking for this search suggest offering above the advertised rent, or paying extra rent up front, to get ahead. In Victoria that advice does not hold.

Consumer Affairs Victoria describes the existing position: the law already bans rental providers “from requiring more than one month’s rent in advance or from soliciting or encouraging higher offers of rent”.

Since 25 November 2025 agents and providers have also been banned from accepting offers above the advertised amount or above one month in advance.

The rule What it means when you apply
Rent in advance, general cap1 month maximum
Where rent is paid weekly14 days maximum
Where rent is above $900 a weekThose limits do not apply
Bond1 month’s rent in most cases, which is 4.345 weeks

Consumer Affairs Victoria, “Rent payments and rent in advance”, last updated 30 March 2026, and “New changes to the rental laws”, last updated 14 October 2026. Bond position from Consumer Affairs Victoria, page updated 5 July 2026.

The practical upshot is that outbidding is not the lever here. What is left is a complete, accurate application handed in early.

Applying also costs nothing now. Since 13 October 2026 rental providers and agents cannot charge you a fee to apply or to pay your rent, and third party platforms have been barred from charging those fees since 31 March 2026.

Timing helps too. The median Melbourne rental leased in 20 days in June 2026, so properties do move, and turning up to the first inspection beats polishing an application for a week.

Where you look changes your odds more than anything on the form. We move renters into Preston and Footscray most weeks, and they are on opposite sides of the city with rental markets that do not price the same way.

What actually strengthens a rental application

With bidding off the table and the form fixed, the differences that remain are unglamorous and largely about being easy to process.

What helps Why
All documents ready before the inspectionYou need only 2 financial and 2 identity documents. Have those 4 files named and ready
Referees who have agreed in advanceAn unreachable referee stalls an application for days
A move in date you can actually meetAgents favour a clean start date over a hopeful one
A short cover note, if you want to send oneVolunteering is allowed. Being asked for it is not
Applying the same day as the inspectionAt a 20 day median time on market, days matter

None of that is a trick. It is simply removing the reasons an agent would set your file aside and pick up the next one.

Get the logistics moving in parallel, because the approval will not wait for you. Our volume calculator sizes the truck, and the packing calculator tells you how many boxes to start collecting.

From approval to keys: the sequence nobody publishes

Every guide on this topic stops at approved. The fortnight after that is where the money and the stress actually are.

Stage What happens What to do in parallel
ApprovedThe agent confirms and sends the agreementBook the truck the same day
SigningBond and rent in advance fall dueApply for a bond loan now if you need one
Before the start dateBond goes to the RTBA, lodged by the agent or, since 9 September 2026, paid by you directlyBook the lift and dock if either place is a tower
Start dateKeys, and the condition reportPhotograph everything before you unpack
First weekUtilities, redirections, condition report returnedChase the old bond, it will not chase itself

Based on how Melbourne moves actually run, not a statutory sequence. Your agreement sets your dates, so read it for the ones that bind you.

The condition report is the row people skip and regret. It is the document that decides your bond a year or two later, and the 30 minutes you spend on it at the start is the cheapest insurance in the process.

Book early rather than accurately. A booked date can usually be shifted; a date that never existed cannot be created in a busy week, and the last 3 days of any month are the busiest in Melbourne.

The window is tighter than it looks. A tower lift commonly needs 1 to 2 weeks of notice, most agreements start on a fixed date, and you often get 7 to 14 days between approval and that date. Two of those 3 numbers are set by someone else.

If both places are towers, the building schedule sets the date rather than the truck. Our page on apartment moves covers that, and for a single bedroom a man with a van is usually enough.

The cash you need on the day

Worth knowing before you sign anything, because it lands in one week.

That is roughly $3,800 before the truck, the connections or a single box. It is why the moving budget gets squeezed last and hurts most.

Vacancy figures vary depending who you read: Domain put Melbourne at 1.4 per cent in September 2026, SQM Research at about 1.9 per cent the same month, and REIV at 2.5 per cent for the metropolitan area in August. They measure differently, so use them as a direction rather than a number.

If the bond is the part standing in your way, there is a Victorian government loan for exactly that, covered in our guide above. For the move itself, keeping a Melbourne move affordable is the practical version, and there is a list of free moving boxes to start with.

Frequently asked questions about renting in Melbourne

The questions below come up on quote calls the week an application is approved. For the wider picture, see our moving house checklist and the Victorian change of address checklist.

Can an agent ask for anything they like on a rental application?

No. Since 31 March 2026 an agent may only request the information set out in Form 3A. Asking for anything else is an offence carrying 60 penalty units for a person and 300 for a company.

How many documents can an agent ask me for?

A maximum of two financial documents and two identity documents. The form also limits rental history to your current or most recent property plus one previous, and references to two referees.

Can they ask about my pets on the application?

Form 3A contains no pet question, so a request for pet information on the application is not permitted. Pets are dealt with separately, after a rental agreement is offered.

Do I have to give a bank statement with my transactions?

The form specifies a bank statement without transaction details. A request for a statement showing your daily spending asks for something the prescribed form does not include.

Can I offer more rent to get the property?

Victorian law bans rental providers from soliciting or encouraging higher offers, and since 25 November 2025 from accepting them too. Outbidding is not a lever available to Melbourne applicants.

Can I still send a cover letter?

Yes. The rule stops an agent requesting information that is not on the form. It does not stop you volunteering material you think helps, and many applicants do.

How much cash do I need on signing?

Usually a bond of one month’s rent plus rent in advance, capped at one month or 14 days where rent is weekly. At the $600 Melbourne median that is roughly $3,800 before moving costs.

Application in? Let’s get the truck sorted

The application side of renting in Melbourne is more regulated, and more in your favour, than most of the advice online suggests. There is one form, there are caps on it, and outbidding is not part of the game here.

What has not changed is the fortnight after approval, when the bond, the advance and the move all land together and the dates are set by other people.

Book the truck the day you are approved, not the day you sign. You can get a free quote and hold the price for a year, which means you can lock a date before the paperwork catches up.
